Does EU Climate Law apply to my business?

No. The EU Climate Law places all of its obligations on the European Commission, relevant Union institutions and Member States, and imposes zero direct compliance obligations on individual enterprises, so a business has no duty to apply it. Entities are affected only indirectly through downstream legislation such as the EU ETS Directive (Directive 2003/87/EC).

Who does EU Climate Law apply to?

It applies to Union institutions, Member States, and all economic sectors whose greenhouse gas emissions or removals are regulated in Union law. The Regulation states that it does not impose direct compliance obligations on individual enterprises.

Does EU Climate Law apply to a small business?

The instrument has no size threshold and no exemption for small businesses. SMEs appear only in Article 4(5), points (j) and (m), as replaced by Regulation (EU) 2026/667, which require the Commission to pay particular attention to SMEs and reduce carbon leakage risk for them when preparing 2040 target proposals.

When does EU Climate Law apply from, and what are the deadlines?

The Regulation entered into force on 29 July 2021 (Article 14). Its deadlines bind the Commission and Member States, not businesses: assessment by 30 September 2023 and every five years thereafter (Article 6(1)), biennial implementation reporting from 6 March 2027 (Article 4(8), as added), and Member State long-term strategies by 1 January 2029 (Article 13(6)(a)).

What does EU Climate Law require me to do?

Nothing. The Regulation places zero obligations on private or public entities such as controllers, processors or any enterprise role, and instead directs the Commission and Member States to adopt and review the sectoral legislation that imposes entity-level duties.

What records or documents does EU Climate Law require me to keep or produce?

None for a business. The Regulation imposes no reporting or notification deadlines on entities, because all 26 of its current obligations fall on the European Commission, Union institutions and Member States.

What happens if I do not comply with EU Climate Law?

Nothing happens to a business, because the Regulation does not contain a penalties article and prescribes no fines, sanctions or enforcement mechanisms against entities. Enforcement operates through the institutional review cycle, including Commission recommendations to Member States under Article 7(2).

How do I start complying with EU Climate Law?

There is no first practical step for a business, because the Regulation places its duties on the European Commission, Union institutions and Member States. The first institutional step is the Commission review of relevant Union legislation by 30 June 2021 under Article 4(2).
