Does EU Deforestation Regulation apply to my business?

The Regulation applies to you if you place relevant products on the Union market, make them available on the Union market, or export them, where those products contain, have been fed with, or were made using cattle, cocoa, coffee, oil palm, rubber, soya or wood (Article 2(1), Article 2(2)). It binds operators, downstream operators and traders (Article 2(15), Article 2(15b), Article 2(17)).

Who does EU Deforestation Regulation apply to?

It applies to three duty-holder classes: operators, downstream operators and traders. An operator places relevant products on the market or exports them (Article 2(15)); a downstream operator places on the market or exports products made using products already covered by a due diligence statement or simplified declaration (Article 2(15b)); a trader makes relevant products available on the market (Article 2(17)).

Does EU Deforestation Regulation apply to a small business?

There is no general size threshold, but a micro or small primary operator subcategory exists under Article 2(15a) for micro or small undertakings established in a low-risk country that place or export products they produced themselves. Under Article 4a it submits a one-time simplified declaration instead of the Article 4(2) due diligence statement and may use a postal address instead of plot geolocation (Article 4a(5)).

When does EU Deforestation Regulation apply from, and what are the deadlines?

The obligations apply from 30 December 2026 under Article 38(2) and from 30 June 2027 under Article 38(3), as postponed by Regulation (EU) 2025/2650. The deforestation-free cut-off is 31 December 2020 under Article 2(13). Reporting duties are event-triggered: Article 4(5) and Article 5(5) require immediate notification, and Article 12(3) requires an annual public report.

What does EU Deforestation Regulation require me to do?

Operators must run due diligence under Articles 8 to 13, submit due diligence statements, and keep a due diligence system reviewed at least annually (Article 12(1), Article 12(2)). Downstream operators and traders collect and keep supply chain information under Article 5, and non-SMEs register in the information system (Article 5(2)) and verify before placing when aware of non-compliance (Article 5(6)).

What records or documents does EU Deforestation Regulation require me to keep or produce?

Operators submit and retain due diligence statements for five years, and keep due diligence system updates for five years (Article 12(2)). Downstream operators and traders collect and retain supplier and customer information for five years under Article 5, and the first downstream operator or trader whose supplier is an operator collects the reference numbers or declaration identifiers (Article 5(3), point (a)).

What happens if I do not comply with EU Deforestation Regulation?

Member States lay down penalties under Article 25(1), and Article 25(2), point (a), sets a Union-wide floor: for legal persons the maximum fine must be at least 4 per cent of total annual Union-wide turnover in the financial year preceding the fining decision. Other sanctions under Article 25 include confiscation of products and revenues, temporary exclusion from public procurement for up to 12 months, and temporary prohibition from placing, making available or exporting.

The first practical step is to fix whether the Regulation applies and which actor category governs each product flow, which the toolkit settles first. Operators then establish and keep up to date a due diligence system under Article 12(1).
