Questions about European Accessibility Act
Does European Accessibility Act apply to my business?
The European Accessibility Act applies to you if you are an economic operator, meaning a manufacturer, authorised representative, importer, distributor or service provider, placing covered products on the market or providing covered services to consumers in the Union. The covered list includes consumer computer hardware and operating systems, self-service terminals, e-readers, electronic communications services, consumer banking, e-books, passenger transport and e-commerce services.
Who does European Accessibility Act apply to?
It applies to manufacturers, authorised representatives, importers, distributors and service providers, collectively the economic operators, from both the public and private sectors, placing covered products on the market or providing covered services to consumers in the Union. Member States, the Commission, market surveillance authorities and service compliance authorities carry the institutional duties.
Does European Accessibility Act apply to a small business?
Yes, with one exemption for microenterprises providing services. Microenterprises providing services are exempt from the service accessibility requirements and related compliance obligations under Article 4(5), while microenterprises dealing with products remain subject to the requirements but carry a lighter documentation duty for the disproportionate burden assessment under Article 14(4). The size thresholds come from the Commission Recommendation of 6 May 2003.
When does European Accessibility Act apply from, and what are the deadlines?
Member States had to adopt and publish the necessary national laws, regulations and administrative provisions by 28 June 2022 and to apply them from 28 June 2025 under Article 31. The accessible answering of emergency communications to 112 has a longer transposition window running to 28 June 2027 under Article 31(3).
What does European Accessibility Act require me to do?
You must meet the accessibility requirements in Annex I for your covered product or service, run the applicable conformity assessment, draw up technical documentation, and draw up an EU declaration of conformity and apply CE marking for products. You must also inform the competent national authority immediately on discovering a non-compliant product or non-conforming service under Articles 7(8), 9(8), 10(5) and 13(4).
What records or documents does European Accessibility Act require me to keep or produce?
Manufacturers must keep technical documentation and draw up an EU declaration of conformity under the Annex IV internal production control procedure. Importers carry a verification, marking, storage and retention cycle, and economic operators relying on the Article 14 exemption must send information on that reliance to the relevant market surveillance authority or service compliance authority under Article 14(8).
What happens if I do not comply with European Accessibility Act?
The Directive sets no fine amounts at Union level. Article 30(1)-(4) requires each Member State to lay down its own rules on penalties for infringement of the national transposing provisions, requiring those penalties to be effective, proportionate and dissuasive, and accompanied by effective remedial action. Market surveillance authorities may also require corrective action and then withdrawal under Article 20.
How do I start complying with European Accessibility Act?
The first practical step is to determine your economic operator role, your enterprise size classification, and whether the fundamental alteration or disproportionate burden exemption procedure under Article 14 and Annex VI applies, which the toolkit settles first.
Which ComplianceSME account includes the European Accessibility Act toolkit?
The European Accessibility Act agent toolkit is included from the Small level.
