Questions about Green Transition Directive

Does Green Transition Directive apply to my business?

The Directive applies to you if you are a trader directing commercial practices at consumers, including producers and sellers of goods, providers of digital content and digital services, and traders providing product comparison services. It bites through the amended Unfair Commercial Practices Directive and Consumer Rights Directive, so check your national transposing law.

Who does Green Transition Directive apply to?

Traders engaging in commercial practices directed at consumers are covered, including producers and sellers of goods, providers of digital content and digital services, and traders providing product comparison services. Member States are the addressees of the Directive itself and must transpose it.

Does Green Transition Directive apply to a small business?

The Directive sets no size threshold and no small business exemption. Public authorities are encouraged, as far as possible and in compliance with Union law, to promote measures easing access to sustainability labels for small and medium-sized enterprises, but this is an encouragement to public authorities, not an entity-facing relief.

When does Green Transition Directive apply from, and what are the deadlines?

Member States must adopt and publish transposing measures by 27 March 2026 and apply them from 27 September 2026 under Article 4(1). The Commission must specify the harmonised notice and label by 27 September 2025 under Article 2(5), Article 22a(2). Traders face no fixed calendar reporting deadlines, only continuous conduct standards and pre-contractual disclosures.

What does Green Transition Directive require me to do?

You must not make misleading environmental or social characteristic claims, must substantiate future-performance claims with a verified implementation plan under Article 6(2)(d) UCPD, and must base sustainability labels on a qualifying certification scheme or public authority under Annex I, point 2a UCPD. You must also give the pre-contractual guarantee, durability, software update and reparability disclosures in Articles 5 and 6 CRD.

What records or documents does Green Transition Directive require me to keep or produce?

A future environmental performance claim requires a documented implementation plan with measurable, time-bound targets, allocated resources and regular independent third-party verification, with findings made public under Article 6(2)(d) UCPD. Guarantee reminders and commercial guarantee disclosures must use the Commission's harmonised notice and harmonised label format under Article 22a CRD once specified.

What happens if I do not comply with Green Transition Directive?

The Directive sets no fine amounts and prescribes no sanctions of its own. The enforcement and penalty regime for breaching the amended UCPD and CRD provisions is the regime each Member State already applies or must apply under its national transposition, so check the position in each Member State where you direct practices at consumers.

How do I start complying with Green Transition Directive?

The first practical step is to check the specific enforcement mechanism and penalty level applicable in each Member State where you direct commercial practices at consumers, since the amended UCPD and CRD leave those figures to national transposing law. Until the Commission adopts the implementing acts, rely on interim wording for the guarantee-reminder disclosures in Files 3 and 4.

Which ComplianceSME account includes the Green Transition Directive toolkit?
