Questions about Machinery Regulation

Does Machinery Regulation apply to my business?

The Regulation applies to you if you place machinery, related products or partly completed machinery on the Union market or put it into service in the Union, including distance selling (Article 2(1)). It also applies if you carry out a substantial modification to such a product already on the market, which makes you a manufacturer (Article 18).

Who does Machinery Regulation apply to?

It applies to manufacturers, authorised representatives, importers, distributors and other economic operators in the machinery supply chain (Article 2(1)). It also applies to any natural or legal person who carries out a substantial modification to machinery or a related product already placed on the market or put into service (Article 18).

Does Machinery Regulation apply to a small business?

The Regulation has no size threshold and no small business exemption. It recognises SMEs only by requiring notified bodies to consider their interests and needs when setting conformity assessment fees (Article 25(5)) and by requiring conformity assessment procedures to avoid unnecessary burdens.

When does Machinery Regulation apply from, and what are the deadlines?

The Regulation applies in full from 14 January 2027 (Article 54), when Directive 2006/42/EC ceases to have effect (Article 51(2)). Products placed on the market in conformity with that Directive before 14 January 2027 may continue to be made available (Article 52(1)).

What does Machinery Regulation require me to do?

You must design and construct to the essential health and safety requirements in Annex III (Article 10(1)), draw up technical documentation, carry out conformity assessment, issue the EU declaration of conformity and affix the CE marking (Article 10(2)). For partly completed machinery you issue the EU declaration of incorporation instead (Article 11(2)).

What records or documents does Machinery Regulation require me to keep or produce?

You must keep technical documentation and the EU declaration of conformity or incorporation at the disposal of market surveillance authorities for at least 10 years (Article 10(3), Article 11(3)). You must also retain supply chain identification records for at least 10 years (Article 19(2)) and tracing logs of safety-critical software uploads for five years (Annex III, section 1.1.9).

What happens if I do not comply with Machinery Regulation?

Member States set the penalties, which must be effective, proportionate and dissuasive, and may include criminal penalties for serious infringements (Article 50(1), Recital 82). Market surveillance authorities can require corrective action and, if it is not taken, order withdrawal, recall or a ban on making the product available (Article 43(4)).

Does Machinery Regulation apply to a UK business selling into the EU?

The Regulation covers products new to the Union market whether manufactured by EU-established entities or imported from third countries, and extends to all forms of supply including distance selling (Article 2(1)). A UK business selling into the EU therefore falls within this scope.

How do I start complying with Machinery Regulation?

The first practical step is to identify your entity role and the market placement conditions for your product, which the toolkit settles first. It also names the risk assessment under Annex III Part B section 1 as the governance starting point for design.

Which ComplianceSME account includes the Machinery Regulation toolkit?

The Machinery Regulation agent toolkit is included in Compliance Complete.
